Your payment terms were rewritten by a document you were never sent.

The supplementary conditions delete a clause of the base contract and replace it. The base contract is not in the package, so there is no original to compare against. That gap is the finding.

SC-1.01 “Defined Terms” The following Terms listed in the General Conditions are modified as follows:

What it replaced

“Contract Time—The number of days or the dates stated in the Agreement to: (i) achieve Milestones, if any and (ii) complete the Work so that it is ready for Final Acceptance.”

What it now says

“Contract Time – The designated time to achieve Final Acceptance as stated in the Agreement.” New terms follow it: Contractor-Specified Time of Completion, and a Daily Value for the Incentive or Disincentive.
